Regional Director Guillermo A. Molina, Jr. IV of the Mines and Geosciences Bureau Regional Office No. V (MGB R.O.-V) through its Confiscation Panel has issued Final Confiscation Order to Sunfil Asia Mineral Resources, Inc. (SAMRI) pursuant to Section 124 of DAO 2010-21 in relation to MGB Memorandum Circular 2018-01 and other pertinent rules.
The seizure has resulted in the confiscation of the 209,000 Cu.M sand and gravel valued at Php97,150,000.00 in favor of the government consistent with Republic Act 7942, DENR Administrative Order 2010-21 and other related laws, rules and regulations for failure to present a valid Sand and Gravel Permit. The seizure order issued by RD Molina dated December 6, 2019 became final and executory last September 16, 2020.

It is to be noted that on December 21, 2018, the Inter-Agency Apprehending Team composed of MGB R.O.-V with the assistance of the National Intelligence Coordinating Agency (NICA), Department of Labor and Employment (DOLE), Bureau of Immigration (BI), Provincial Environment and Natural Resources of Albay (PENRO-ALBAY), Philippine National Police (PNP) of Malilipot,Albay and Barangay Officials of Brgy. Binitayan, Malilipot, Albay found out that a processing plant was in operation without any permit from the concerned agencies which this Office seized the extracted sand and gravel amounting to Php97,150,000.00.
The action of MGB RO-V is in pursuance of the mandate of the MGB as a vigilant steward of the country’s mineral resources consistent with the promotion of sustainable mineral resources development through responsible mining.
